1. Acceptance
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. We may update these Terms from time to time; continued use constitutes acceptance of the revised Terms.
2. Nature of Service
SmartFinBox is a loan discovery and lead‑generation platform operated by Bubbling Pot LLP. We are not a bank or NBFC and do not provide loans or set interest/charges. We enable you to submit your details and be connected with third‑party lending partners (banks/NBFCs/FinTechs) who evaluate eligibility, complete KYC/underwriting, and may extend credit at their sole discretion.
3. Eligibility
You must be 18 years or older, legally capable of contracting in India, and using the Platform for lawful purposes. You agree to provide true, accurate, and complete information and keep it updated. If you act for a business, you confirm you are duly authorized.
4. User Account & Authentication
You may access services with OTP or account credentials. You are responsible for maintaining confidentiality of your login and for activities under your account. Notify us immediately of any unauthorized use.
5. Your Consents
By submitting details, you consent to (a) our collection and processing of your personal data for providing Platform services; (b) sharing your data with lending partners and service providers (e.g., verification/KYC, analytics, communications) for evaluating and processing your application; and (c) being contacted via phone, SMS, WhatsApp, RCS, email, and push notifications (including if your number is on DND/NDNC). You may opt‑out of marketing at any time as per the Privacy Policy.
6. Credit Information & KYC
Our lending partners may require KYC (PAN/Aadhaar etc.) and may access your credit information from credit bureaus with your explicit consent. SmartFinBox itself does not take lending decisions and does not guarantee approval. Any sanction amount, tenure, APR, charges, repayment schedule and documentation are between you and the lender.
7. Fees & Charges
SmartFinBox does not charge users for using the discovery service. Lender fees/charges (processing, pre‑payment, foreclosure, late payment, etc.) are determined by the lender and shown by the lender before you accept any offer.
8. Acceptable Use
You agree not to (i) use the Platform for unlawful, harmful, or fraudulent purposes; (ii) attempt to gain unauthorized access or interfere with the Platform; (iii) submit information you do not have the right to share; (iv) copy, scrape, or reverse engineer any part of the Platform.
9. Third‑Party Links & Offers
The Platform may contain links to third‑party websites/apps and lender offers. We do not control or endorse their content, terms, privacy practices, or decisions. Access and transactions with third parties are at your sole risk.
10. Intellectual Property
All content, trademarks, logos, UI, software, and materials on the Platform are the intellectual property of Bubbling Pot LLP or its licensors. You receive a limited, revocable, non‑transferable right to use the Platform for personal, non‑commercial purposes in accordance with these Terms.
11. Service Availability & Changes
We may modify, suspend, or discontinue any feature or the entire Platform at any time, with or without notice. We do not warrant uninterrupted or error‑free operation..
12. Limitation of Liability
To the maximum extent permitted by law, SmartFinBox/Bubbling Pot LLP and its officers, partners, employees, and agents shall not be liable for (i) indirect, incidental, special, consequential, or punitive damages; (ii) loss of profits/revenue/data; (iii) decisions or actions of lenders; (iv) denial of loan or change in terms by lenders; (v) any reliance on information provided on or through the Platform. Our aggregate liability, if any, shall not exceed INR 1,000 or the amount you paid to us (if any) in the preceding 3 months, whichever is lower.
13. Indemnity
You agree to indemnify, defend and hold harmless Bubbling Pot LLP/SmartFinBox from claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising from your (i) use or misuse of the Platform; (ii) breach of these Terms or applicable law; (iii) infringement of third‑party rights.
14. Data Protection & Cookies
Processing of personal data is governed by our Privacy Policy. We use cookies/SDKs and similar technologies for login, analytics, attribution, and marketing (e.g., GA4, Google Ads/Meta pixels/SDKs, and attribution partners such as AppsFlyer).
15. Termination
We may suspend or terminate access if we believe you have violated these Terms or any applicable law, or for operational/security reasons. On termination, your right to use the Platform ceases immediately.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Courts at Bengaluru, Karnataka shall have exclusive jurisdiction. You agree to first attempt an amicable resolution by writing to the Grievance Officer before approaching courts.
